Use technology and information resources to research issues in U.S. Courts.

Due Week 8 and worth 150 points

The Fourth Amendment of the U.S. Constitution limits the power of the police to make arrests, search people and their property, and seize objects and contraband, such as illegal drugs or weapons. These limits are the bedrock of search and seizure law and are ultimately at the root of your right to privacy.

Analyze the following case in preparation for a systematic approach to your synthesis of law and fact:

Terry v. Ohio located at http://caselaw.lp.findlaw.com/cgi-bin/getcase.pl?court=us&vol=392&invol=1

Write an eight to ten (8-10) page legal Memorandum paper in which you:

Summarize five (5) key aspects of Terry v. Ohio.
Posit whether or not you believe law enforcement violated Terry and the other men’s right to privacy which the Fourth Amendment guarantees. Justify your position.
Examine the dissenting opinion of Justice Douglas, as discussed in the case. Discuss the origins and importance of probable cause as it relates to law enforcement’s discretion to search Terry’s car in this case.
Examine the two part test provided by the Court in Terry that first asks whether the officer’s action is justified at its inception; and second, asks whether it is reasonably related in scope to the circumstances which justified the interference in the first place.Discuss whether or not this test leaves officers with too much discretion when making a determination to stop an individual. Provide a rationale for your response.
Examine the Court’s holding in Terry that provides that probable cause is based upon the totality of the circumstances. Review the factors that help shape the totality of circumstances, such as specialized knowledge of the officers, investigative inferences, personal observations of suspicious behavior, and information from other sources. Question whether these factors in question are too subjective to establish probable cause. Provide a rationale for your response.
Debate the validity of the Court’s holding that “whenever a police officer accosts an individual and restrains his freedom to walk away, he has “seized” that person with the meaning of the Fourth Amendment. Justify your response.
Use at least two (2) quality references. Note: Wikipedia and other Websites do not qualify as academic resources.

Your assignment must follow these formatting requirements:

Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; citations and references must follow APA or school-specific format. Check with your professor for any additional instructions.
Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required assignment page length.

Grading for this assignment will be based on answer quality, logic/organization of the paper, and language and writing skills, using the following rubric.

Summarize security measures that might be taken as well as their potential impact on the staff’s ease of use of the information system.

For ethical, legal, and business reasons, the security of health care data must be a top priority in health care organizations. HIPAA, for example, requires that health care organizations safeguard patient data, and there are serious consequences for breaches of privacy. Yet organizations have many types of sensitive clinical or administrative information they need to protect. To make their systems secure, health care organizations put in place policies as well as technical safeguards such as encryption and passwords. There can be a tradeoff, however, between system security and ease of use by health care providers.

Prepare for this Application Assignment as follows:

Select a type of health care organization, such as an outpatient clinic, nursing home, or hospital, and a specific department or function in this setting, such as a nursing unit, radiology department, or admissions, that would make use of sensitive health data. Bring to mind specific ways in which these data might be improperly accessed, lost, stolen, and so on.
Review this week’s Learning Resources, and conduct online research, as needed, to clarify for yourself the ramifications for individuals and organizations of security breaches in this department, and the solutions that have been devised to protect these data. In what ways might these security measures interfere with the staff’s ease of use of the system? Consider how best to balance these competing interests of data security and convenience for staff.

Then write a 2- to 3-page paper that addresses the following:

Describe key challenges for your selected health care department in ensuring that its sensitive data are secure. Illustrate with specific examples, and address not only technological issues but also human factors involved in ensuring its system security.
What are some implications of security breaches of its health care data? Who might be impacted and how?
Summarize security measures that might be taken as well as their potential impact on the staff’s ease of use of the information system.
Explain what you believe is the appropriate balance between data security and ease of use

Would it help your case if the jurisdiction made such a defense available to bars and liquor stores that required buyers to provide proof of age?

Most states make it a crime to purchase alcohol for a minor, sometimes called the shoulder tap crime, based on the typical manner a request by a minor for an adult to buy alcohol occurs. These crimes generally do not require proof that the defendant knew the person was underage.

Should the same strict liability apply to a host of a party that is attended by both adults and minors, where alcohol at the private party is furnished to both?
Should a host be able to offer evidence that he reasonably believed the minor was old enough to drink?
Would it help your case if the jurisdiction made such a defense available to bars and liquor stores that required buyers to provide proof of age?

Discuss their rights and liabilities. How would this differ from a limited partnership. What are the requirements to create both?

Jake and Kate are two members of an LLC with 15 members. This is a member-managed LLC with three of the members identified as the managers. Kate is one of these managers, though Jake is not. In reality, Jake and Kate together do most of the management for the LLC, contributing approximately equal amounts of time and energy. They both have spent some of their own money on behalf of the LLC. In one situation, Jake and Kate each put up $1,000 as a deposit on a contract entered into on behalf of the LLC that the other two managers voted to not perform. Jake and Kate want to be compensated for their time, want their expenses covered, and are worried about liability on the unperformed contract. Discuss their rights and liabilities. How would this differ from a limited partnership. What are the requirements to create both?

Learning Activity #2

Lisa entered into a limited partnership as a limited partner by investing $25,000 in cash. There were a total of 50 limited partners and 20 general partners. The partners elected a management committee that included two of the general partners and Lisa as one of the limited partners. The certificate of limited partnership was completed, but was filed with the wrong office. The partnership then commenced business. Some of the parties with whom it conducted business assumed that the partnership was general partnership because they searched the records of the secretary of state and found no certificate of limited partnership or any other record. Others assumed that it was a general partnership but had not actually searched the filings. Still others assumed that it was a limited partnership. In addition, among those who assumed that it was a limited partnership, some assumed that Lisa was a general partner and others did not.
