Contractors, Inc. contracted with College to build a 20-room, 2 story classroom building, constructed of gray bricks, and according to architectural specifications provided by College. The building is to be located on campus at the corner of Campus Way and Academic Avenue at a contract cost of $5,000,000, and to be completed by August 1, 2013. This August 1 deadline would give College just enough time to move into the building and prepare the inside for classes to begin August 14. College informed Contractors that time was of the essence and that this is a tight time-line for moving into the new building.

The valid, written contract read, in part, as follows:

We, the undersigned, party of the first part, hereinafter College, and party of the second part, hereinafter Contractors, Inc. hereby agree to the following:

1) Contractors, Inc. will build a 20-room, 2-story classroom building constructed of gray bricks, at the corner of Campus Way and Academic Avenue Avenue, in accordance with the architectural specifications stipulated by College and attached hereto and in compliance with Maryland building codes and regulations for new construction;

2) Contractors, Inc. will complete the construction project at a total cost of $5,000,000, inclusive;

3) Contractors, Inc. will complete the construction project not later than August 1, 2013. Time is of the essence.

A. On May 28, 2013, after the construction was more than half completed, the cost of bricks used for construction of the building increased substantially in the marketplace so that Contractors could no longer construct the building for $5,000,000. Contractors told College that it would need an additional $250,000 to complete the building using gray bricks on the exterior. College agreed to modify the original contract to increase the construction costs by $250,000, bringing the total cost of the project to $5,250,000.

College and Contractors drew up the following contract modification as an addendum to the original contract:

After the contract modification, Contractors continued to work on the building but did not meet the August 1 completion deadline. The building was completed on August 21, 2013.

In the meantime, fall semester classes began at College on August 14, making it necessary for College to lease classroom space from August 14-September 4, 2013. College necessarily had to hold classes in the leased space for 3 weeks until September 4 because it took 2 weeks (from August 21) for College to move into the new building and prepare it for classes. The lease costs were $5,000 per week, for a total of $15,000 for 3 weeks.

College paid Contractors $5,000,000 on September 4, but refused to pay the additional $250,000.

College filed suit against Contractors for breach of contract. Contractors counter sued College for breach of contract.

These are the guidelines that describe performance of completing the summary/evaluation memos. The basic goals of the summary portion of your memo follow:

Summarize completely. (Include the author’s thesis, main points, and conclusions.)
Paraphrase. (Put the author’s ideas into your own words.)

The basic goals of the evaluation portion of your memo follow:

Relate the reading to personal experience.
Use logical, well-developed examples to explain the response to the reading.
Demonstrate critical thinking.

Instractions:

Length: Summaries roughly should be 10-15% of the original. Thus, if you are summarizing a ten page article, your summary should be two to three pages. Your evaluation should be brief yet complete, using PERSONAL EXAMPLES from your experience at work, in school, through reading/watching media, and other venues that inform your insights into why you agree with, disagree with, or wish to modify in some way the author’s main argument.
Protocol:

Follow the template provided in The attachments. That means: Use those four headings to organize your summary/evaluation. You are summarizing when you identify the author’s THESIS, MAIN POINTS, and CONCLUSIONS. You switch from “summary” guidelines at that point and start using “evaluation” guidelines in the final memo/email heading, EVALUATION.

In short: THESIS/MAIN POINTS/CONCLUSIONS sections of your memo/email refer to the author’s argument, while you are speaking from your own experience, using first-person voice if you wish, in the EVALUATION section.

Get copies of Martin Luther King Jr.’s “Letter from Birmingham City Jail” and Jonathan Swift’s “A Modest Proposal.” You can get the copies from attachments.
Summarize King’s and Swift’s documents. Paraphrase their theses, main points, and conclusions. To accomplish this feat, look for the six features of successful proposals.

Successful proposals and reports:

Define a problem.
Define a solution.
Discuss the advantages of the solution.
Anticipate and refute objections to the solution.
Discuss how to implement the solution.
Justify costs of the solution.

When you find these features of successful proposals in Swift’s and King’s documents, you have found their theses and main points. Look for their conclusions in the paragraph(s) ending their documents.

Evaluation Section: Present comparative analysis of the two documents in the evaluation section of summary/evaluation memo answering these two qustions:

How would Swift’s audience have reacted to his “Modest Proposal” if Swift had used King’s tone?
How would King’s audience have reacted to his “Letter” if King had used Swift’s tone?

This assignment consists of two (2) sections: a business requirements document and a project plan. You must submit both sections as separate files for the completion of this assignment. Label each file name according to the section of the assignment it is written for. Additionally, you may create and / or assume all necessary assumptions needed for the completion of this assignment.

Documenting the existing IT network and system is an important first step, but you, the CIO, know that capturing the needed changes can be critical to your success as an executive. You know that procuring and documenting quality business requirements is an important step toward the design of quality information systems. Completion of a quality requirements document allows user needs and expectations to be captured, so that infrastructure and information systems can be designed properly. Using the requirements document provided in the course shell as a part of the requirements gathering process, you are to assess the needs of the company as it prepares to become a multinational organization. You must consider current and future trends and requirements; however, assumptions should be realistic and carefully considered. The needs of the organization should be documented.
